Terms of Service

Last updated: 14 September 2026. These Terms of Service ("Terms") govern your access to and use of the Eleva Pro Technology website, products, and services. By accessing or using the Services, you agree to be bound by these Terms.

Where a separate written agreement (such as a master service agreement, statement of work, or order form) applies to a specific engagement, that agreement governs and prevails over these Terms for that engagement.

1. Definitions

  • "Eleva", "we", "us", "our" refers to Eleva Pro Technology, the operator of the Services.
  • "User", "you", "your" refers to any individual or entity accessing or using the Services.
  • "Content" refers to text, images, code, designs, video, audio, and other material made available through the Services.

2. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) and able to form a binding contract to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Acceptable Use

You agree not to:

  • Promptly notify us of any unauthorized use of your account.
  • Accept responsibility for all activities that occur under your account.

5. Intellectual Property

5.1 Our content

The Services and all Content provided by us are the property of Eleva Pro Technology or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may view, download, and print Content for your personal, non-commercial use, provided you keep all copyright and other proprietary notices intact.

5.2 Your content

When you submit content to us (for example, through the contact form or newsletter signup), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and distribute such content for the purposes described in our Privacy Policy.

5.3 Project deliverables

Ownership and licensing of any code, design, document, or other deliverable produced under a paid engagement are governed exclusively by the applicable written agreement (such as the master service agreement or statement of work), not by these Terms.

The Services may integrate with or link to third-party services (such as Google Cloud Storage, Google Analytics, Meta, LinkedIn). We do not control and are not responsible for the availability, accuracy, or content of any third-party service. Your use of third-party services is governed by their own terms and privacy policies.

7. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

The information published on the Services (including blog posts and case studies) is provided for general informational purposes only. It does not constitute professional advice.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ELEVA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICES.

Where liability cannot be excluded, our aggregate liability arising out of or relating to these Terms or the Services will not exceed one hundred US dollars (USD 100) or the equivalent in your local currency.

9. Indemnification

You agree to indemnify, defend, and hold harmless Eleva Pro Technology and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your Content, or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. The provisions of these Terms that by their nature should survive termination will survive, including but not limited to ownership, disclaimers, indemnification, and limitations of liability.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Arab Republic of Egypt, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts of Cairo, Egypt, unless a specific written agreement provides otherwise.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. Continued use of the Services after a change constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
